Regal Orchids Terms and Conditions
Welcome to the Regal Orchids website terms and conditions for use. These terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions you may not use or access this Website.
Before you place an order, if you have any questions relating to these terms and conditions please contact our sales department by email (sales[at]regalorchids.co.uk) or by telephoning our office on 01259 210569. Please note that all calls to our sales department will be charged at the local rate (BT users only, other network charges may vary) and may be recorded for quality monitoring and training purposes.
Use of the Website
1: Access. You are provided with access to this Website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.
2: Indemnity. You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your Personal Information.
3: Our Rights. We reserve the right to:
• modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or
• change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.
Purchase of Products
1: Availability. Plants are offered strictly subject to availability. Should a variety be sold out or not considered of highest quality, we reserve the right to send an alternative of a similar type, variety or colour of equal or higher value unless specifically notified at the checkout stage.
1.1: Gift Orders. Where a plant ordered as a gift is not suitably ready (ie. In spike but not yet in bud/flower) we reserve the right to replace it/them with other suitable variety/ies of as close to possible as the one chosen on ordering. Regal Orchids retains the final right to this decision.
2: Prices. Shop items prices are starting prices that will alter at checkout based on customer selection of size, number of stems, quantity etc. Prices on the website are subject to change without prior notice. Latest online pricing supersedes all previous prices.
2.1: Item prices in the website shop may contain an element of postage and packaging where the item is particularly heavy, too large to fit in standard boxes with other order items or requires an individual box (especially when in bud/flower).
2.2: Postal charges. Postal charges are now calculated by individual item and not by weight. We will always find the best method of shipping your order as speedily as possible but with every care to the protection of the goods during delivery. We therefore may have to send more than one box or split sundry items from plants to avoid chance of transit damage. With increasing fuel charges and couriers charging additional rates for home deliveries, postal charges on our site may fluctuate from time to time.
3: Order Processing. Orders are processed strictly by rotation. That is, we will process previous orders first before more recent orders. If you require an urgent delivery we can 'fast track' it for an additional fee of £4, payable at checkout. Orders are usually processed within 2 days of receipt of the order transaction, however at peak times of the year the period might be 5 days or more. Customers will not be notified of the delay unless they specifically request so by email. Customers will receive a confirmation email when the goods have been dispatched, detailing estimated time of delivery and delivery tracking codes when available.
4: Delivery. Goods are dispatched strictly on Mondays and Wednesdays (occasionally Thursdays if non urgent). We do not send goods at other times to avoid potential delays in transit during weekends.
4.1: Packages delivered that require a signature should be checked thoroughly upon receipt for any sign of damage before any signature is given. The courier/driver is obliged (by most courier companies) to wait at least 5 minutes for you to confirm the box/goods are undamaged prior to signing.
4.2: Damage to goods. Courier companies are taking less and less care of goods in transit so be aware that although we have packed your items with the utmost care and the boxes upon delivery appear undamaged, the goods within can still have been damaged.
4.3: Insurance. Perishable items including plants, glassware, ceramics etc are no longer insured by any courier company that we know of. Unfortunately this means that any damage to your items upon receipt cannot be claimed for (even if for example the courier has failed to deliver on time – see note 5 below). Regal Orchids cannot be held responsible for damage to perishable items caused by failure of a third party courier to deliver the goods on time.
5: Compensation. Damaged packages should be reported to the carriers and ourselves immediately upon receipt. Should a courier company fail to deliver within the time specified, Regal Orchids can make a claim to the courier on behalf of the customer for the delay (not for any subsequent damage to the goods caused by this delay.) In any other case, Regal Orchids will be happy to provide all additional information to the customer regarding the shipping of the goods by the courier if the customer chooses to make a claim directly.
6: Online Payments. Payments by Credit card incur a 2% transaction processing charge while Debit cards including Maestro/Solo incur a 25p surcharge as specified by the credit card companies.
7: Purchases: Regal Orchids accepts no responsibility for goods bought in error. Please note that plants on offer are living and may not always be in flower. Some varieties are more suitable for the amateur or experienced grower and not suitable as gifts.
7.1: Updates: Although we make every attempt to keep the website up to date with regular changes, plants shown on the website as ‘in bud/flower’ may no longer be suitable (if for example, the early blooms are starting to go). It is therefore Regal Orchid’s decision whether to replace the item with another similar variety (see point 1 above) or to offer reimbursement to the customer by way of a redeemable voucher.
8: Online Security. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.
9: Refunds: We hope you will be pleased with your purchase. Should you wish to return anything bought from us, we will be happy to refund or exchange a product provided it is in fully resaleable condition. Returns should be made within a reasonable time (usually 28 days) and in original, undamaged packaging.* Please see below for exceptions to this policy.
If the product returned is not in fully resaleable condition or the packaging is damaged, we reserve the right to refuse a refund on the item, or deduct up to 25% of the original selling price from the refund amount. This does not affect your statutory rights.
9.1: Products we are unable to refund or exchange. We are unable to offer a refund or exchange on perishable goods (eg plants and flowers) unless they are faulty: *
9.2: Delivery charges. We will refund your original delivery charge when a product is faulty or damaged*, but not when a product is simply unwanted.
10: Gift vouchers. Regal Orchids gift vouchers can be exchanged for goods in all Regal Orchids shops and where we are at shows and can also be used to purchase goods online at regalorchids.co.uk or when placing an order over the telephone.
10.1: Gift vouchers cannot be exchanged for cash.
10.2: If the goods purchased online total less than the value of the gift voucher, we will send you further vouchers to equal the credit amount which can be redeemed against subsequent orders.
10.3: Gift vouchers may not be used to discharge indebtedness on any account with Regal Orchids, nor to purchase further gift vouchers.
10.4: When redeeming gift vouchers online or over the telephone you will be required to give the serial number of the voucher. Once the gift voucher has been used for shopping online or over the telephone the voucher will be void.
10.5: If your gift vouchers become accidentally damaged beyond repair or lost, they will be considered void.
11: Promotional Discounts. Promotional discount codes, flyers and coupons offered by Regal Orchids are valid only for use as part of a purchase made via our online shop, unless otherwise stated. Such promotional discounts are not valid for use as part of a purchase in Regal Orchids shops, or for telephone orders.
*Faulty or damaged goods (specifically plants and flowers) must be notified to us within 7 days of receipt. We cannot be held responsible for any faults or damage to perishable goods that have arisen once goods have arrived or from failure of the service provided by third party couriers or delivery firms.
